Terms of Use
Welcome to Koibolo. These Terms of Use (“Terms”) govern your access to and use of the Koibolo website and application (collectively, the “Service”) operated by Koibolo (“we,” “our,” or “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Plain-English summary: Use Koibolo for language learning, keep your account secure, don’t abuse the platform, and understand that AI-generated lesson content may not always be perfect. We can terminate accounts that violate these Terms.
1. Eligibility
You must be at least 13 years of age (or 16 in the European Economic Area / UK) to use the Service. By using Koibolo, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent’s or guardian’s permission.
2. Account Registration
To access personalized lessons, you must create an account by providing a valid email address and a password. You agree to:
- Provide accurate and complete registration information.
- Keep your password confidential and not share it with anyone.
- Notify us immediately at support@koibolo.com if you suspect unauthorized access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to refuse account registration or suspend accounts at our discretion.
3. Free and Premium Tiers
Free Tier
The Free tier is available at no charge and includes personalized lessons, a placement assessment, spaced-repetition review, and progress tracking. The Free tier is supported by contextually placed advertisements. By using the Free tier, you consent to the display of such advertisements. We reserve the right to adjust the features and ad frequency of the Free tier at any time.
Premium Tier (Coming Soon)
A paid Premium subscription will unlock additional features including ad-free learning, stories, conversation practice, and more. Pricing and billing terms for Premium will be disclosed at launch. All purchases are subject to our refund policy, which will be provided at the time of purchase. Subscriptions auto-renew unless cancelled before the renewal date.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service, its servers, or related systems.
- Reverse-engineer, scrape, copy, or redistribute any content or AI-generated output from the Service for commercial purposes without our written consent.
- Upload content that is infringing, defamatory, obscene, or otherwise harmful.
- Use automated bots, scripts, or other means to generate requests at a volume that degrades the Service for other users.
- Attempt to circumvent or disable ad-serving mechanisms on the Free tier.
- Impersonate another person or entity.
5. AI-Generated Content
Koibolo uses large language models (including Anthropic Claude) to generate personalized lesson content, feedback, and corrections in real time. You acknowledge that:
- AI-generated content may occasionally contain errors, inaccuracies, or inconsistencies. It is not a substitute for instruction from a qualified language teacher.
- You should not rely solely on Koibolo for high-stakes language use (e.g., medical, legal, or safety-critical communication).
- Lesson content generated by AI is provided “as is” for educational purposes only.
6. Intellectual Property
The Koibolo name, logo, platform design, underlying technology, and all non-AI original content are owned by Koibolo and protected by applicable intellectual property law. Nothing in these Terms transfers any ownership interest to you.
You retain ownership of any original content you submit to the Service (e.g., custom vocabulary lists or uploaded images). By submitting such content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.
Anonymized, aggregated learner data (e.g., common vocabulary gaps across a language group) may be used to improve the platform. Raw lesson input is not shared or sold.
7. Third-Party Links
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those sites. Accessing third-party links is at your own risk.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Language learning outcomes depend on individual effort, consistency, and prior knowledge. We make no guarantee that use of Koibolo will result in any particular level of language proficiency.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KOIBOLO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KOIBOLO IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.
10. Termination
You may stop using the Service and delete your account at any time via your Profile page. We reserve the right to suspend or terminate your access to the Service, with or without notice, if we determine in our sole discretion that you have violated these Terms or that continuation of your account poses a risk to other users or the platform.
Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 11, and 12 survive termination.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in [State], and you consent to personal jurisdiction in those courts.
Note: Jurisdiction clause will be finalized when Koibolo’s registered address is established.
12. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify registered users by email. Your continued use of the Service after any revision constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
